AMATEUR PHOTO RULES CONTEST
ARTICLE 1: ORGANIZER
The company RUGBY200th, located at 22 rue Henri Barbusse 92300 Levallois-Perret
(hereinafter referred to as "the Contest") from June 5, 2023, to June 18, 2023, to celebrate the Bicentennial of Rugby. The winners will be selected by the jury at the end of the contest.
ARTICLE 2: REGISTRATION PROCEDURE
Participation in the contest is free, and registration will be done through the Organizer's platform accessible at the following addresses: https://rugby200th.by-vs.com/
Participants can submit their photos and invite friends to submit their photos until the closing date of the contest, which is June 18, 2023, at midnight. The winners will be notified by email if their photos have been selected for evaluation by the jury and inclusion in the professional and amateur photos that will be exhibited at one of the designated sites during the Rugby World Cup from September 8, 2023, to October 28, 2023 (Champs-Elysées, Jardin d'Acclimatation, or other locations TBC) and published in the exhibition catalog book "Rugby Bicentennial" by Éditions en Exergue.
La participation étant ouverte aux mineurs de plus de 15 ans, ces derniers devront fournir l’autorisation des parents, les titulaires de l’autorité parentale ou, à défaut, les tuteurs légaux (ci-après les « Parents ») par le biais d’une autorisation parentale téléchargeable lors de l’inscription, qui devra être complétée et signée. (Cf autorisation parentale à télécharger et remplir ci-après en Annexe).
ARTICLE 3: PARTICIPATION CONDITIONS
The Contest is open to amateur photographers from around the world
Participation by minors is subject to prior consent from the Parents, as mentioned in Article 2
The Organizer reserves the right to automatically cancel the participation of a minor in the Contest in the absence of this authorization. Any false statement or lack of consent will result in the automatic cancellation of a minor's participation in the Contest.
Each person is allowed only one entry, and each participant may submit up to 3 (three) photographs.
The photographs should depict rugby action, the rugby atmosphere, pre-match, gameplay, halftime, post-match, and/or the specificities, values, and traditions of rugby. The photographs must not infringe upon any person and must not constitute an offense to decency, incite to commit crimes or offenses, provoke discrimination, hatred, or violence.
Digital manipulation of images: :
Digital manipulation (brightness, contrast, color balance) is allowed to optimize the image, as well as cropping and removing minor defects. However, adding or removing an important element from the composition that would distort the photograph is prohibited. The jury has the authority to reject any image that, in its judgment, has been excessively retouched compared to the original image.
The photo must also comply with the following technical specifications:
File format: JPEG
- "Portrait" or "landscape" format : ratio 3:2 (36x24), 4:3 (32x24), square
- Resolution: minimum 2500 x 3750 pixels
- Resolution: 300 dpi
- Maximum of 3 photos per person
- Photo size: Maximum 10 MB/file
Other criteria
The photographs must include:
- The location of the shot (Country, City, or Stadium).
- The context (Team XXX vs. Team YYY Match).
- The author's name, first name.
Regarding framing, retouching, or any modification of the photo, the participant must adhere to the following constraints :
- Cropping is allowed without the obligation to maintain the original aspect ratio.
- Photos can be in color or black and white.
Correction of minor defects and localized retouching, including the removal of commercial trademarks.
The following are not allowed:
- Photo montages.
- Signatures on photos.
- Photos created using artificial intelligence (AI).

The organizer reserves the right to crop photos to fit standard publishing formats.
ARTICLE 4: JURY COMPOSITION
The Jury consists of 9 (nine) members (with a total of 10 votes) representative of the rugby world :
– President Yvon Rousset, initiator of the exhibition (2 votes).
– Pierre Rabadan, Deputy Sports Officer of the City of (1 vote).
– Dominique Issartel, journalist and Grand Reporter at L'Équipe (1 vote).
– Isabelle Ithurburu, sports journalist and television presenter (1 vote).
– Marie Bourret, Rugby International (1 vote).
– Brett Gosper ex CEO de World Rugby et Publicitaire (1 voix),
– Philippe Guillard, writer and director (1 vote).
– Jean-Baptiste Lafond, Rugby International (1 vote).
– A representative of the exhibition venue (1 vote).
The composition of the Jury may evolve, including the addition of a representative from the exhibition sponsor if desired.
This Jury will evaluate the selected photos from the amateur contest, as well as a few professional photos (including a selection of photos from the Michel Birot collection), and select approximately 150 to 200 (two hundred) photos, referred to as the “photos”, according to the number of photos necessary for the photo exhibition, depending on the exhibition venue.
The photographs will be evaluated based on their technical and artistic value and their alignment with the editorial line of the planned exhibition, which is "before, during, and after a rugby match, regardless of the country or level".
The decisions of the Contest Jury are final.
ARTICLE 5: WINNERS
After the Contest and following the jury's deliberation, the winners will be notified by email that their photos have been selected to be part of the "Bicentenary of Rugby" book published by "En Exergue" and the exhibitions planned as part of the Bicentenary celebration during the Rugby World Cup in France from September 8, 2023, to October 28, 2023.
The Organizer reserves the right, in the event of an event beyond its control, particularly related to its suppliers or unforeseeable circumstances, to modify the exhibition venues based on various authorizations and agreements that may not be obtained and/or the requirements of different partners involved in the celebration process. The winners will be informed of any changes and will waive any claims in this regard.
A prize ceremony for the Bicentenary photo award is scheduled between October 18 and October 28, 2023, but the location and details are yet to be confirmed.
ARTICLE 6: IMAGE RIGHTS - PERSONAL ATTRIBUTES
By participating in the Contest, participants grant the Organizer permission, without any remuneration, rights, or benefits, to use their names, first names, and images, provided they have been communicated as part of the Contest and under the following conditions :
On any communication medium, including print, digital, electronic, existing (press, internet, poster, exhibition catalog, etc.), or future.
- On any medium.
- Worldwide.

- Regarding any form of public communication of various nature (e.g., for the promotion of the Organizer's brands, products, and activities, as part of any advertising and promotional action or event, etc.).
Contest participants must have the right to the image and authorization from the identifiable person(s) in the photograph.
If a participant submits a work in which the main subject is one or more identifiable minors, they must have obtained the authorization of the parent(s) of the respective minor(s). In any case, the responsibility lies with the Contest's Organizer rather than the photographer.
Each participant declares and guarantees to the Organizer that they are the author of the submitted photograph. The participant guarantees the originality of the photograph and, in particular, that it does not infringe on any pre-existing work that could generate claims from third parties. This ensures that the Organizer cannot be disturbed by a third party, and its liability cannot be questioned during the exploitation of the photograph.
The author of the photograph guarantees that the photograph does not infringe on the rights of third parties and does not contain any defamatory content or content that infringes on the privacy, honor, or reputation of third parties.
ARTICLE 7: INTELLECTUAL PROPERTY
Participants agree not to infringe on trademarks. Additionally, each participant acknowledges and agrees that the Organizer's website, as well as all materials, data, and content provided by RUGBY200th, including the design text of the Organizer's website, software in the form of code (including applets) appletsscripts, downloads, graphics, photos, etc., as well as their selection and arrangement, and the trademarks, trade names, trade dress, service marks, and logos contained therein, are the property of RUGBY200th and are subject to copyright and other applicable intellectual property rights. All rights not expressly granted to the participant in this rules contest or in the terms of use of the Organizer's website are reserved.
By publishing their photograph(s) as part of the Contest, each participant:
- warrants and represents to the Organizer that they are the author of the photograph(s) and/or that they hold the rights to the photograph(s), and that the photograph(s) do not violate any third-party rights, including any third-party intellectual property rights (in this case, the participant will be disqualified in accordance with Article 9, and the Organizer reserves the right not to exhibit and/or edit the photo(s) and/or take legal action against the winner before any competent jurisdiction).
By registering for the Contest, the participant grants the Organizer, for a period of 2 years (two years) from June 5, 2023, and worldwide, the exploitation rights to the photographs submitted to the contest, whether or not they are selected by the jury, for promotional purposes related to the Contest or the Exhibitions.
This assignment includes:
- the right of reproduction: the right to reproduce the photographs, without limitation in number, by any technical means and on any known or future medium, including press and internet media, notably through printing, production of graphic, magnetic, videographic, digital, or electronic media, online and offline media, for all types of publications, including but not limited to newspapers, books, magazines, catalogs, mailings, editions, and derivative product creations;
- the right of representation: the right to present, make accessible, exhibit, broadcast, or communicate the photographs directly or indirectly to the public in any public and/or private place, by any known or future modes and processes, free of charge or for a fee, as well as to translate the captions if necessary.
The photographs submitted or selected by the jury may be made available to the press with their copyright or on social networks for the purpose of promoting the contest or the exhibitions.
It is specified that the photographs will remain visible as archives on RUGBY200th's digital media for 5 (five) years from June 18, 2023.
ARTICLE 8: RESPONSIBILITIES
The Organizer shall not be held liable if, due to a case of force majeure or any event beyond its control, the Contest and its exhibitions were to be canceled, extended, shortened, postponed, or modified. Similarly, the Organizer shall not be held liable, and no action may be taken against it, in the event of force majeure as defined by Article 1218 of the French Civil Code and French jurisprudence, which would partially or completely prevent participants from participating in the Contest and/or receiving the rewards promised for the photos selected by the exhibition or publication jury. The Organizer reserves the right to modify the rules at any time and to make all decisions it deems necessary for the application and interpretation of the rules. The Organizer may inform participants by any means of its choice. The Organizer also reserves the right to modify, extend, shorten, suspend, postpone, or cancel the Contest or one or more sessions thereof, or to modify the access conditions and/or operating procedures without prior notice.
The Organizer shall not be held responsible for any direct or indirect damage, regardless of its causes, origins, nature, or consequences, even if it has been informed of the possibility of such damages due to:
- Malfunctioning of the Internet or the participant's computer equipment (hardware and/or software and/or databases and/or data) or, more generally, any other problem related to networks, telecommunications resources and services, computers (online or offline), servers, Internet access and/or hosting providers, computer equipment or software, databases, and anyone's data.
- Anyone's access to the Website or its official pages on social networks or the inability to access them.
- The use or inability to use the Website, including any damage or virus that may infect the participant's computer equipment or any other equipment of the participant and/or the Organizer.
ARTICLE 9: WARRANTIES
The Organizer reserves the right to exclude any participant, without having to justify its decision, if it considers that the content provided by the participant (or any element of their participation) may be considered:
- Detrimental to the Organizer and contrary to its material and/or moral interests.
- Likely to violate French and European legislation, including, but not limited to, if the work is contrary to public order and good morals.
- Contrary to public order and good morals.
- Defamatory, racist, xenophobic, negationist, or infringing on the legitimate interests of third parties, inciting discrimination or hatred towards a person or a group of people based on their real or perceived ethnic origin, nationality, race, or religion.
- Pornographic or pedophilic.
- Inciting the commission of a crime, a felony, an act of terrorism, or glorifying war crimes or crimes against humanity.
Therefore, participants guarantee the Organizer against any claims, liability actions, damages and losses (including legal fees) incurred or related to the violation of any of the warranties or commitments made under these rules.
ARTICLE 10: OBLIGATIONS
Participation in the Contest implies acceptance of these rules by the participants.
Any participation that violates the rules will be excluded from the contest without any right to compensation. Any false or inaccurate statement, fraud, or attempted fraud, cheating, or attempted cheating will result in the exclusion of the offending participant.
The Organizer is solely competent to judge, without bias, any dispute relating to the Contest or the rules, based on doubts and evidence collected to justify and provide proof of its decision.
In the event of fraud or false or inaccurate statements, the Organizer reserves the right to initiate legal proceedings against the relevant participant in any competent jurisdiction.
ARTICLE 11 - PROCESSING OF PERSONAL DATA
– Purposes and methods of processing personal data
The personal data (hereinafter "Data") that you provide to us when participating in the Contest will be processed for the following purpose: participation in the Contest.
– Personal data collected
The Data that will be collected are as follows:
For participants aged 18 and above:
- The first name and last name of the photographers who submit their photographs to the Jury,
The email address of the photographer, which will be visible during the submission of photographs.
For minor participants:
The first name and last name of the photographer;
- The email address of the photographer;
- The age of the participant (date);
- The first name and last name of the parent of the minor, the holder of parental authority, or the legal guardian;
- The postal address of the parent of the minor, the holder of parental authority, or the legal guardian.
Consequences of not providing the data
Failure to provide the Data marked as mandatory will prevent you from participating in the Contest.
– Recipients of the data
The Data may be processed by the Organizer and the service provider, By-VS.
– Data retention
Les Données traitées seront conservées pendant toute la durée du Concours et la période de 2 ans (deux) de conservation des photos à compter du 18 juin 2023. (Conformément à l’ARTICLE 6)
– Data Controller and Data Protection Officer
The Data Controller is the Organizer.
In accordance with Articles 15 to 21 of the GDPR and the "Informatique et Libertés" law of January 6, 1978, amended by Law No. 2018-493 of June 20, 2018, the participant can exercise the following rights:
A. Right of access, which means the right to obtain confirmation from the Organizer as to whether your Data is being processed and, if so, access to such Data ;
b. Right to rectification and right to erasure, which means the right to obtain the rectification of inaccurate and/or incomplete Data, as well as the erasure of Data ;
c. Right to restriction of processing, which means the right to request the suspension of processing;
Right to object, which means the right to object to the processing of Data when the request is legitimate, including when the Data is processed for marketing or profiling purposes;
Right to lodge a complaint with a supervisory authority in case of unlawful processing of Data ;

ARTICLE 12 - DISPUTES
This rules contest is subject to French law, including the current French regulation on contests.
To be considered, any disputes related to the contest must be submitted by email to rugby200th@gmail.com no later than thirty (30) days after the participation deadline for the Contest as indicated in this rules contest.
Any disputes arising during the Contest will be subject to an attempt at amicable settlement between the Organizer and the participant. In the absence of an agreement, the dispute will be submitted to the competent courts in accordance with the provisions of the French Code of Civil Procedure.
