5 – Commande<\/span><\/b>\u00a0<\/span><\/p>

Pour passer commande\u202fsur le site web : choisir\u202fun produit au travers d\u2019une fiche descriptive, un format parmi ceux propos\u00e9s, la (les) option(s) parmi celles propos\u00e9es et s\u00e9lectionner une quantit\u00e9 (1 par d\u00e9faut). Puis appuyer sur le bouton \u00ab\u202fAjouter au panier\u202f\u00bb. Une ic\u00f4ne \u00ab Panier \u00bb situ\u00e9 dans le \u00ab\u202fHeader\u202f\u00bb permet de visualiser \u00e0 tout moment la commande en cours, la nature des produits, leurs prix et leurs quantit\u00e9s. Vous avez la libert\u00e9 de modifier ou de supprimer la commande. Il est alors possible de continuer vos achats ou de \u00ab\u202fCommander\u202f\u00bb. Si vous choisissez \u00ab\u202fCommander\u202f\u00bb, un r\u00e9capitulatif de commande apparaitra. Vous pourrez ajuster votre commande en quantit\u00e9 ou supprimer des articles. 6 – Moyens de paiement et s\u00e9curit\u00e9 des paiements<\/span><\/b>\u00a0
By-VS propose plusieurs solutions de paiement, par cartes bancaires, Apple Pay, Google Pay ou par un compte Paypal.<\/span>\u00a0<\/span><\/p>

Les paiements par carte bancaire sont r\u00e9alis\u00e9s via le syst\u00e8me s\u00e9curis\u00e9 STRIPE ou PAYPAL qui utilisent le protocole SSL (Secure Socket Layer), assurant que les informations transmises sont crypt\u00e9es et qu’aucun tiers ne peut en prendre connaissance au cours de la transaction et sur le r\u00e9seau. Les paiements via Apple Pay se r\u00e9alise avec un appareil Apple compatible pour l\u2019achat et apr\u00e8s avoir configur\u00e9 Apple Pay dans le Wallet. La transaction est valid\u00e9e par un Face ID ou un Touch ID, le paiement est alors ex\u00e9cut\u00e9 automatiquement par Apple. Les paiements via Google Pay sont possibles si vous disposer d\u2019un compte Google auquel est rattach\u00e9 un moyen de paiement valide. Apr\u00e8s avoir conclu votre achat et confirm\u00e9 votre r\u00e8glement, l\u2019op\u00e9ration de paiement est automatiquement ex\u00e9cut\u00e9e par Google.<\/span>\u00a0<\/span><\/p>

By-VS\u202fn\u2019a pas acc\u00e8s \u00e0 vos informations bancaires.<\/span> Les commandes sont valid\u00e9es d\u00e9finitivement et les d\u00e9lais de livraison communiqu\u00e9s commencent \u00e0 courir, qu\u2019\u00e0 compter de la seule date \u00e0 laquelle le paiement a \u00e9t\u00e9 accept\u00e9.\u00a0<\/span>\u00a0<\/span><\/p>

7 – Clause de r\u00e9serve de propri\u00e9t\u00e9<\/span><\/b>\u00a0<\/span><\/p>

Les produits restent la propri\u00e9t\u00e9 de<\/span> By-VS jusqu\u2019au r\u00e8glement et \u00e0 l\u2019encaissement total du montant factur\u00e9, ainsi que des frais suppl\u00e9mentaires qui auraient pu \u00eatre g\u00e9n\u00e9r\u00e9s. Les risques sont n\u00e9anmoins transf\u00e9r\u00e9s \u00e0 l\u2019acheteur \u00e0 compter de la livraison.<\/span>\u00a0<\/span><\/p>

8 – Livraison et Modes de livraison<\/span><\/b>\u00a0
By-VS livre les produits dans les territoires couverts par les solutions de son logisticien\u202f: France M\u00e9tropolitaine, Outre-Mer, Europe UE, Suisse, Europe de l\u2019Est (Hors UE et Russie), Norv\u00e8ge, Maghreb, Monde. Un ensemble d\u2019\u0153uvres command\u00e9es est exp\u00e9di\u00e9 en un seul envoi, et le format du produit le plus volumineux d\u00e9termine les conditions de livraison. Nous vous invitons \u00e0 nous contacter pour toute demande particuli\u00e8re (<\/span>Contact Us<\/span>).<\/span> By-VS propose automatiquement le mode de livraison selon le produit command\u00e9\u202f: Colissimo, Colissimo International, Lettre suivie, Lettre suivie internationale. Il est de la responsabilit\u00e9 du client de s\u2019assurer que la commande pourra lui \u00eatre livr\u00e9e dans des conditions normales, avec des conditions d\u2019acc\u00e8s adapt\u00e9es. 9 – Adresse de livraison<\/span><\/b>\u00a0
La livraison sera effectu\u00e9e \u00e0 l’adresse communiqu\u00e9e lors de la saisie de la commande. Les adresses de livraison et de facturation peuvent \u00eatre diff\u00e9rentes. Toutes erreurs dans les coordonn\u00e9es de livraison (destinataire, adresse…) qui pourraient engendrer une impossibilit\u00e9 pour nos prestataires logistiques d\u2019accomplir leur mission de livraison sont de la seule responsabilit\u00e9 du client. Les frais suppl\u00e9mentaires g\u00e9n\u00e9r\u00e9s (retour, stockage, nouvelle livraison\u2026) seront \u00e0 la charge du client qui s\u2019engage \u00e0 en supporter les co\u00fbts et \u00e0 les r\u00e9gler avec diligence afin que By-VS puisse livrer \u00e0 nouveau le produit. En l\u2019absence du r\u00e8glement des frais suppl\u00e9mentaires, By-VS consid\u00e9rera la commande comme r\u00e9gl\u00e9e partiellement et exp\u00e9diera \u00e0 nouveau la commande qu\u2019une fois l\u2019ensemble des r\u00e8glements sold\u00e9s. Une fois la commande enregistr\u00e9e, le changement de l\u2019adresse de livraison est impossible. 10 – D\u00e9lai <\/span><\/b>\u00a0
Le d\u00e9lai de livraison est indiqu\u00e9 sur la fiche produit. Le d\u00e9lai de livraison communiqu\u00e9 est estimatif \u00e0 compter de l\u2019encaissement total de la commande par By-VS. Le d\u00e9lai indiqu\u00e9 est d\u00e9pendant du d\u00e9lai de fabrication et du mode de livraison choisis. En cas de retard de livraison ou encore d\u2019une impossibilit\u00e9 de pouvoir livrer le produit pour des raisons de force majeure (gr\u00e8ve, incendie, inondation, catastrophes naturelles\u2026) aucune demande d’indemnisation, de quelque nature que ce soit, ne pourra \u00eatre r\u00e9clam\u00e9e par le client. By-VS fera tous ces efforts afin de respecter les d\u00e9lais indiqu\u00e9s et son devoir d\u2019information du client. Le choix du mode d\u2019exp\u00e9dition et du transporteur appartient \u00e0<\/span> By-VS<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>

11 – R\u00e9ception de la livraison<\/span><\/b>\u00a0
IMPORTANT<\/span><\/b>\u202f: <\/span>Lors de la r\u00e9ception de votre commande, il est de la responsabilit\u00e9 du client d’ouvrir le colis en pr\u00e9sence du livreur pour contr\u00f4ler et constater le bon \u00e9tat du (des) produit(s) livr\u00e9(s).<\/span><\/b> Si vous avez mandat\u00e9 un tiers pour r\u00e9ceptionner la marchandise, il est de votre responsabilit\u00e9 et de votre int\u00e9r\u00eat de l\u2019informer et de le sensibiliser de cette proc\u00e9dure. Lors du contr\u00f4le des produits, si vous constatez une anomalie, une d\u00e9gradation, un d\u00e9faut qui remet en cause la qualit\u00e9 des produits, <\/span>vous devez imp\u00e9rativement REFUSER la livraison et surtout NE PAS SIGNER le bon de livraison.\u00a0 <\/span><\/b>Remettez-le(les) colis au livreur en lui indiquant les raisons de votre refus, et contactez-nous le jour m\u00eame par courrier \u00e9lectronique<\/span>. <\/span>By-VS ne pourra malheureusement accepter aucune r\u00e9clamation si le bon de livraison a \u00e9t\u00e9 sign\u00e9, y compris avec une indication compl\u00e9mentaire \u00ab\u202fsous r\u00e9serve de\u202f\u00bb qui n\u2019a aucune valeur.<\/span><\/b> Aucune action ne pourrait alors \u00eatre engag\u00e9e aupr\u00e8s du transporteur ou du logisticien.<\/span>\u00a0<\/span><\/p>

12 -\u202fDroit de r\u00e9tractation\u00a0<\/span><\/b>\u00a0<\/span><\/p>

By-VS attire l\u2019attention du client sur le fait que certains produits propos\u00e9s sont uniques, num\u00e9rot\u00e9s, personnalis\u00e9s, qu\u2019ils sont \u00e9dit\u00e9s et fabriqu\u00e9s \u00e0 la demande. Par cons\u00e9quence, ces produits ne peuvent b\u00e9n\u00e9ficier du droit de r\u00e9tractation pr\u00e9vu dans les dispositions de l\u2019article L121-20-2 du code de la consommation. Les produits command\u00e9s ne seront ni repris, ni \u00e9chang\u00e9s, en dehors de l\u2019application de la garantie sur les vices de qualit\u00e9.<\/span>\u00a0<\/span><\/p>

Dans le cas de produits non personnalis\u00e9s, le client a la possibilit\u00e9 dans les 14<\/span> (<\/span>quatorze) jours ouvr\u00e9s, \u00e0 partir de sa date de r\u00e9ception, de retourner les produits sans en justifier la motivation. Les produits doivent \u00eatre renvoy\u00e9s \u00e0 la charge du client \u00e0 l\u2019adresse que communiquera By-VS<\/span> (<\/span>le client contactera d\u2019abord By<\/span>–<\/span>VS qui lui donnera l\u2019adresse pour son retour). Ils doivent \u00eatre imp\u00e9rativement dans leur \u00e9tat d\u2019origine (complets, propres, non-endommag\u00e9s) et dans leurs emballages d\u2019origine. By-VS refusera syst\u00e9matiquement le remboursement de tout retour ne respectant pas ces crit\u00e8res. Aucun retour en contre remboursement ne sera accept\u00e9.\u00a0<\/span>\u00a0<\/span><\/p>

Apr\u00e8s r\u00e9ception du (des) produit(s) retourn\u00e9(s) et contr\u00f4l\u00e9(s) par By-VS, le remboursement, hors frais d’exp\u00e9dition, sera effectu\u00e9 sur le mode de paiement initial utilis\u00e9 pour la commande, dans les 60 jours (date de r\u00e9ception). 13 – Droit de retour<\/span><\/b>\u00a0<\/span><\/p>

Dans le cas d\u2019une livraison non-conforme \u00e0 la commande, en dehors d\u2019un d\u00e9faut de qualit\u00e9, le client b\u00e9n\u00e9ficie d\u2019un droit de retour. Il doit alors contacter By-VS par email dans les 3 (trois) jours ouvr\u00e9s maximum apr\u00e8s la r\u00e9ception de la livraison. Apr\u00e8s avoir pu constater la non-conformit\u00e9 de la livraison, By-VS organisera le retour et la livraison de la commande initiale. Les frais de reprise, de transport et de livraison seront \u00e0 la charge de By-VS<\/span>.<\/span>\u00a0<\/span><\/p>

Pour tous produits livr\u00e9s non-conformes sur le plan de la qualit\u00e9, le client doit contacter By-VS par email dans les 3 (trois) jours ouvr\u00e9s maximum. Apr\u00e8s avoir pu constater la non-conformit\u00e9 de la livraison, By-VS organisera la reprise et la livraison d\u2019un produit de remplacement. Si le produit n\u2019est plus disponible en stock, By-VS proposera au client une alternative \u00e0 prix \u00e9quivalent. Les frais de reprise de transport et de livraison seront \u00e0 la charge de By-VS<\/span>.<\/span>\u00a0<\/span><\/p>

14 – Exon\u00e9ration de responsabilit\u00e9 et Garantie<\/span><\/b>\u00a0<\/span><\/p>

Les repr\u00e9sentations visuelles des produits pr\u00e9sents sur le site sont garanties par By-VS comme fid\u00e8les \u00e0 la r\u00e9alit\u00e9.
